1) Changes to the Services or Terms
We may update the Services and these Terms from time to time. The Effective Date above reflects the latest version. If changes materially affect your rights or obligations, we will use reasonable means to notify you. Continued use after changes means you accept the updated Terms.
2) Eligibility
You must be the age of majority in your jurisdiction to use the Services or place orders. If you use the Services on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
3) Accounts and Security
You are responsible for activities under your account and for safeguarding your credentials. Notify us promptly of any suspected unauthorized use.
4) Orders, Pricing, Taxes, and Availability
- Offers & Errors: We may refuse or cancel orders if an item is mispriced, out of stock, restricted by law, suspected of fraud/abuse, or otherwise inconsistent with our policies.
- Prices: Prices are shown in U.S. Dollars unless stated otherwise and may change without notice.
- Taxes: Applicable taxes are added at checkout based on your shipping address and current rules.
- Fitment/Compatibility: Product fitment guides are provided for convenience and may not be exhaustive. You are responsible for verifying compatibility with your specific vehicle and trim before installation or use.
5) Shipping, Delivery, Returns, and Exchanges
- Shipping & Risk of Loss: We ship within the timeframes stated at purchase acknowledgement. Title and risk of loss pass upon our delivery of the goods to the carrier, unless otherwise required by applicable law.
- Inspection: Inspect packages upon receipt. Report missing/damaged items promptly with photos and order details.
- Returns/Exchanges: Our current return/exchange terms, restocking fees (if any), and RMA procedures are available upon request via info@optimaxauto.com or (858) 397-2324. Certain items may be non-returnable (e.g., installed/used electricals, custom/special orders), subject to consumer law.
6) Product Information; Installation and Use
- Aftermarket/Performance Parts: Many products are designed for specific configurations. Improper selection or installation can cause damage, safety hazards, or warranty denial.
- Professional Installation Recommended: Unless instructions clearly indicate otherwise, professional installation is recommended.
- Off-Road/Track Use: Some items may be for off-road/track use only and may not be street-legal in all jurisdictions. You are responsible for compliance with local laws and emissions rules.
- Torque/Load Ratings: Follow the manufacturer’s torque specs and load ratings. Do not exceed vehicle/roof rack dynamic or static load limits. Re-check fasteners after initial use.
- No OEM Affiliation: Product and vehicle names are for identification only. Optimax is not affiliated with, sponsored by, or endorsed by vehicle manufacturers unless expressly stated.
7) Intellectual Property
The Services, including text, graphics, logos, images, videos, and other content, are owned by Optimax or its licensors and are protected by IP laws. You may not copy, modify, distribute, or create derivative works without prior written permission.
8) User Content and Reviews
If you submit content (e.g., reviews, photos, messages), you grant Optimax a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for operating and improving the Services. You represent that your content does not infringe others’ rights or applicable law.
DMCA: If you believe content infringes your copyright, contact info@optimaxauto.com with:
(1) your contact information; (2) identification of the work claimed to be infringed; (3) identification of the material and its location; (4) a statement under penalty of perjury of good-faith belief; (5) a statement that you are the copyright owner/authorized agent; and (6) your physical or electronic signature.
9) Prohibited Conduct
You agree not to: (a) violate laws or others’ rights; (b) misuse the Services (scraping, reverse engineering, or introducing malware); (c) interfere with security or access controls; (d) misrepresent identity or affiliation; (e) engage in fraudulent or abusive returns; or (f) circumvent product, pricing, or availability restrictions.
10) Disclaimers
THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMAX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES—YOUR RIGHTS MAY VARY.
11) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OPTIMAX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. IN ANY EVENT, OPTIMAX’S AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR USD $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW SUCH LIMITATIONS—YOUR RIGHTS MAY VARY.
12) Indemnification
You agree to defend, indemnify, and hold harmless Optimax from claims arising out of your use of the Services or products, your content, or your violation of these Terms or applicable law.
13) Privacy

14) Governing Law; Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
- Arbitration; No Class Actions: Except for small-claims matters or claims for injunctive relief, disputes will be resolved by binding individual arbitration in San Diego County, California before a single arbitrator under the JAMS rules. You and Optimax waive any right to a jury trial and to participate in a class or representative action.

Time Limit to Bring Claims: Any claim must be filed within one (1) year after it accrues, unless prohibited by law.

15) International Users
We operate from the United States and make no representation that the Services or products are appropriate in other locations. You are responsible for compliance with local laws.
16) Termination
We may suspend or terminate access to the Services at any time for any reason, including violations of these Terms. Sections that by nature should survive termination will survive.
